Privacy Policy

Last updated: September 2025

This Privacy Policy describes how RideArt ("we," "us," or "our") collects, uses, protects, and handles your information when you use the RideArt mobile application ("App"). We are deeply committed to protecting your privacy and ensuring transparency regarding our data practices.

1. Information We Collect

We collect information directly from you when you provide it to us, and automatically as you interact with our App.

Information You Provide Directly:

Account and Profile Information: When you create an account, we collect personal identifiers such as your username, email address, password, and any other profile information you choose to provide (e.g., your car interests, location preferences for events, biographical details). This information is used to establish and maintain your user profile within the App.

User Content Data: As the App's core functionality involves user-generated content, and requires explicit access to your device's camera and microphone (with your permission), we collect the photos, videos, audio recordings, descriptive text, comments, and associated metadata (e.g., date, time, location if you enable location services for photos/videos) that you create, upload, or otherwise submit through the App. This content is integral to your use of the App's "Tour," "Explore," and "Organize" features.

Communications: If you communicate with us through customer support inquiries, feedback forms, or other channels, we collect the content of those communications, as well as your contact information, to address your requests and improve our services.

Transaction Information (for "Shop" feature): If you engage in transactions within the "Shop" section of the App, we may collect information necessary to facilitate these transactions. Please note that for actual payment processing, we typically rely on third-party app store providers (e.g., Apple App Store, Google Play Store) or external payment gateways. In such cases, we do not directly collect or store sensitive payment card information, and your payment is subject to the privacy policies and terms of service of those third-party providers.

Information Collected Automatically (from your interactions with the App):

Usage Data: We automatically collect data about how you access and interact with the App. This includes details of your visits to the App, traffic data, location data (if permitted by your device settings), logs, and other communication data and the resources that you access and use on the App. It also encompasses information about the features you use, the content you view, your search queries within the App, the time and duration of your activities, and any errors encountered during your use. This helps us understand popular features and areas for improvement.

Device Information: We collect information about the mobile device you use to access the App, including the device model, operating system version, unique device identifiers (e.g., device ID, advertising ID), mobile network information, IP address, and browser type. This helps ensure compatibility and optimize performance across various devices.

2. How We Use Your Information

We use the information we collect solely for the following legitimate business purposes:

To Provide, Operate, and Maintain the App: To enable you to create and manage your account, upload and display User Content, facilitate interaction with other users, and provide access to all App features, including "Tour," "Explore," "Shop," and "Organize" functionalities.

To Personalize Your Experience: To tailor the content, features, and overall user experience within the App to your expressed interests, preferences, and historical interactions with the App and User Content.

For Internal Analytics, Research, and Improvement: To continuously analyze usage patterns, understand user behavior, identify trends, diagnose technical issues, and enhance the overall performance, security, and usability of the App. This includes developing new features, optimizing existing ones, and improving the relevance of content suggestions.

To Communicate with You: To send you essential service-related notifications, updates about the App, security alerts, and to respond to your customer support inquiries or feedback.

To Enforce Our Terms and Policies: To monitor for and investigate potential violations of our End User License Agreement, detect and prevent fraudulent or abusive activity, and protect the rights, property, or safety of the Company, our users, or others.

For Legal Compliance: To comply with applicable laws, regulations, legal processes, and governmental requests, and to enforce our legal rights.

3. Sharing of Your Information

We are committed to not selling, renting, or otherwise sharing your personal information or User Content with third parties for their marketing or other independent commercial purposes.

We may disclose your information in the following limited circumstances:

With Your Explicit Consent: We may share your information if you provide us with clear and affirmative consent to do so for a specific purpose.

For Legal Reasons: We may disclose your information if required to do so by law, court order, or governmental regulation, or in the good faith belief that such action is necessary to:

  • Comply with a legal obligation (e.g., a subpoena or court order).
  • Protect and defend the rights or property of the Company (e.g., to enforce our EULA).
  • Prevent or investigate possible wrongdoing in connection with the App.
  • Protect the personal safety of users of the App or the public.
  • Protect against legal liability.

Third-Party Service Providers (strictly for App operations): We may engage trusted third-party service providers to perform functions on our behalf and help us operate the App, such as hosting services, data storage, security services, or analytics providers. These third parties will only have access to your information as necessary to perform their functions and are contractually obligated to maintain the confidentiality and security of your information and not use it for any other purpose.

4. Data Security

We implement commercially reasonable and appropriate technical and organizational security measures designed to protect your information from accidental loss, unauthorized access, use, alteration, and disclosure. These measures include data encryption (both in transit and at rest where feasible), firewalls, access controls, and regular security assessments. While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee the absolute security of your personal information.

5. Your Choices and Rights

You have certain rights regarding the information we hold about you:

Access and Correction: You can typically access, review, and update your account information and certain User Content directly within the App's settings or profile section. We encourage you to keep your information current.

Deletion: You may request the deletion of your account and associated personal information by contacting us at the email address provided below. Please note that while most data will be promptly removed, some information may be retained in our records for a certain period to comply with legal obligations (e.g., tax or accounting purposes) or for legitimate business purposes (e.g., dispute resolution, enforcement of agreements).

Device Permissions: You have control over the App's access to your device's camera and microphone through your device's operating system settings. You can grant or revoke these permissions at any time. However, disabling these permissions will significantly limit or prevent your ability to use certain core App features (e.g., uploading photos/videos).

Opt-Out of Communications: If you receive promotional emails from us, you may unsubscribe by following the instructions contained within those emails. Even if you opt-out of promotional messages, we may still send you non-promotional communications, such as service-related alerts or technical notices.

6. Children's Privacy

Our App is not intended for use by, nor is it directed to, individuals under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you believe that your child under the age of 13 has provided us with personal information, please contact us immediately. If we become aware that we have inadvertently collected personal information from children under 13 without verification of parental consent, we will take prompt steps to remove that information from our servers.

7. Links to Other Websites

The App may contain links to websites or services operated by third parties. This Privacy Policy does not apply to the practices of third parties, and we are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party websites or services you visit.

8. Changes to This Privacy Policy

We reserve the right to update or modify this Privacy Policy from time to time in our sole discretion. Any changes will be effective immediately upon posting the revised Privacy Policy on this page. We will notify you of any material changes by updating the "Last Updated" date at the top of this Privacy Policy and, where appropriate, by providing a more prominent notice (e.g., through an in-app notification or email). You are advised to review this Privacy Policy periodically for any changes. Your continued use of the App following the posting of the revised Privacy Policy constitutes your acceptance of the changes.
